I just had the opportunity to take a “Short Sales” class with PGCAR. This class was taught by Jill Pogach Michaels, the principal owner of Michaels Title & Escrow. The class was very interesting and full of good information. As you all know, REALTORS® should NOT negotiate short sales on behalf of the owner. I want to make sure everyone understands that there is no exception to this rule. One of the ways that REALTORS® attempt to get around this rule is to say that you are just a facilitator or a liaison between the seller and the bank but at the end of the day this is still considered as negotiating and unlawful practice of law. PLEASE make sure that when you take a listing that is a short sale you immediately direct the seller to hire a Real Estate attorney to handle the negotiations. I understand that some of you feel that you are very knowledgeable when it comes to short sales but you must also understand that every short sale is different, every bank is different and you cannot use the one size fits all approach. One mistake, no matter how well intentioned you are can prove to be fatal. We will have Mrs. Michaels attend an upcoming sales meeting where she can answer your questions and point you in the right direction. In the meantime, please feel free to contact her firm directly for assistance with your clients. Mrs. Michaels and her firm has successfully negotiated around 2000 short sales and I feel that her fees are reasonable for what they do.
